These terms are an agreement between you and [COMPANY LEGAL NAME] ("Phone Sniper", "we", "us") for your use of the Phone Sniper website and service. By creating an account or using the service, you agree to them.

The service

Phone Sniper is software for sending text messages, emails and direct mail, and for managing contacts and conversations. Plans include a monthly number of texts and phone numbers, as shown on our pricing page.

Your account

Keep your login details private. You're responsible for activity under your account and for the accuracy of the business information you give us, including for carrier registration.

Your responsibilities when you send messages

You are solely responsible for the messages, emails and mail you send through Phone Sniper and for complying with all laws that apply to them, including the Telephone Consumer Protection Act, the CAN-SPAM Act, carrier and industry messaging rules, and state telemarketing and privacy laws. This includes obtaining any consent the law requires, honoring opt-out requests, respecting calling and texting hours, and keeping your own do-not-contact records. Phone Sniper's guardrails (such as opt-out handling and texting hours) are tools to help you, not legal advice or a guarantee of compliance.

You agree not to use the service to send spam, deceptive or harassing content, or content about prohibited categories under carrier rules, and not to import contacts you have no lawful basis to contact. We may pause sending or suspend accounts that put our numbers, carrier relationships or other customers at risk.

Plans, billing and cancellation

Plans are billed monthly in advance through our payment processor. Texts beyond your plan's monthly amount are billed at your plan's per-text rate. Letters, postcards and other paid add-ons are billed as used. You can change or cancel your plan from your billing page; cancellation takes effect at the end of the current billing period. Fees already paid are not refunded except where required by law.

Phone numbers and registration

Phone numbers provided with your plan are assigned to you while your account is active and may be reclaimed after cancellation. Carrier registration is reviewed by third parties; we can't guarantee approval or review times, and numbers can't send until registration is approved.

Your data

You own the contact lists and content you put into Phone Sniper. You give us permission to use them only to provide and support the service. See our privacy policy.

Availability and changes

We work to keep Phone Sniper running but don't promise it will be uninterrupted or error-free. We may change or improve features; we'll give notice of changes that significantly reduce what your plan includes.

Disclaimers and limits of liability

The service is provided "as is." To the fullest extent the law allows, we disclaim implied warranties, and our total liability for any claim is limited to the amount you paid us in the three months before the claim. We aren't liable for indirect or consequential damages, lost profits or lost deals.

Indemnity

You agree to defend and indemnify us against claims arising from the messages, emails or mail you send, the contacts you upload, or your violation of these terms or the law.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
